KATN Strength Engine – WARRANTY

Thank you for purchasing the KATN Strength Engine. We stand by the strength engine’s design and build quality and offer the following warranty.

WHAT IS COVERED

KATN warrants that the KATN Strength engine (Product) shall be free from defect in material and workmanship (outside of “normal” wear) for a period of one year from the date of purchase. Assuming the Product is used under normal uses and conditions, as recommended in the user guide.

During the warranty period KATN will, at no additional charge to you, repair or replace the cage or any part of the internal element if it becomes defective, malfunctions, or otherwise fails to conform with this Limited Warranty. All labor shall be the responsibility of the owner.

Original Proof of Purchase and Product Number is required to invoke this warranty.

WHAT IS NOT COVERED

This Limited Warranty does not cover normal wear and tear on items such as rope, labels, or the expected wear on the internal element (mandrel and fairlead).

This warranty is void if the Product is improperly stored, maintained, re-assembled, altered and/or modified in any way. 

It does not cover misuse/abuse or accident/damage such as scratches, lost labels, damaged rope, or cosmetic damage to paint/finishes.

As described in the user guide, the product requires maintenance and this warranty does not cover claims resulting from failure to maintain or improper maintenance nor does it cover repair for any noises such as: squeaks, clunks, thumps resulting from poor or lack of preventive maintenance.

This Limited Warranty does not extend to any Product that is damaged or rendered defective; (a) as a result of accident, misuse, or abuse; (b) use with the Product of any part not manufactured or sold by KATN or affiliates; (c) by modification of the Product; (d) by normal wear and tear. 

Should any Product submitted for warranty service be found ineligible, an estimate of repair cost will be furnished.

Any labor cost is the responsibility of the original purchaser. If a Product requires shipment, delivery or transport it is the purchaser's sole responsibility and to pay for any fees associated with servicing of a Product. Any evidence of alteration, erasing or forgery of proof-of­ purchase documents voids this Limited Warranty. 

DISCLAIMED WARRANTIES

THE PROVISIONS OF THIS WARRANTY ARE IN LIEU OF ANY OTHER WARRANTY, WHETHER EXPRESS OR IMPLIED, WRITTEN OR ORAL. TO THE MAXIMUM EXTENT ALLOWED BY LAW, ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO EXPRESS WARRANTY, IMPLIED WARRANTY, WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND WARRANTY OF NON-INFRINGEMENT OF INTELLECTUAL PROPERTY, ARE EXPRESSLY EXCLUDED TO THE MAXIMUM EXTENT.

WARRANTY CLAIM PROCESSING

To obtain warranty service, you must contact us directly. Warranty claims must be accompanied by proof of purchase.

KATN may, at its option, repair or replace any defective Product frame or parts with new or serviceable used parts that are equivalent in function to the original parts. All exchanged frames and parts replaced under this warranty will at the time of service become the property of KATN.

KATN reserves the right to change manufacturers of any parts to cover any existing warranty. Any parts determined to be defective must be returned to KATN to obtain warranty service. You must prepay any shipping charges, export taxes, customs duties, and taxes, or any other charges associated with transportation of the parts or Product. In addition, you are responsible for ensuring any parts or Product shipped or returned. You assume the risk of loss during shipment.

THE USE OF INFORMATION PROVIDED THROUGH THE KATN SERVICE IS SOLELY AT YOUR OWN RISK AND IS NOT MEDICAL OR HEALTHCARE ADVICE.

Purchase Agreement – Liability Release

The risk of injury from the activities involved in strength and conditioning is significant, including the potential for serious personal injury, and while particular rules, equipment and personal discipline may reduce this risk, the risk of serious injury does exist; and, 

By purchasing a product from KATN, you knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees (as defined below) or others, and assume full responsibility for my use

of the product; and,

With the purchase of the product you and on behalf of my heirs, assigns, personal representatives and next to kin, hereby release and hold harmless KATN, LLC, their officers, officials, agents and / or employees, other participants sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (“Releasees”), with respect to any and all injury, disability, death or loss or damage to person or property, whether arising from the 

negligence of the Releases, or otherwise; and,

By purchasing a KATN product, you willingly agree to comply with the stated and customary terms and conditions for product use.  You agree to indemnify, defend, and hold harmless KATN LLC and its directors, officers, employees, and agents, from and against all claims, damages, losses and costs that arise from or relate to 

KATN product use or KATN training methodology. 

Your purchase requires you to have read the user guide and you agree to comply with all rules and guidelines set by KATN LLC. 

With your purchase, you will indicate that you have read this release of liability and assumption of risk agreement and fully understand its terms.  By acknowledging and agreeing to the Terms and Conditions and the liability release therein, you also understand that you have given up certain rights by signing it, as described above, which you agree to do voluntarily.
